By acknowledging our contract, you understand and agree to our Terms of Service Agreement and are hereby under a binding contract with Denvyrs Air Conditioning and Heating for services rendered in the specified job description located above. All payments are to be made out to “Assisting Seniors Kindly Inc.”, which is the sole entity tied to the DBA “Denvyrs Air Conditioning and Heating.” I understand that all services rendered and completed are due upon completion, failure to pay may result in a daily interest charge of 8% interest, and is subject to additional late fees. All equipment installation’s, if payment is not met, will be removed and recovered by Denvyrs Air Conditioning and Heating.
3 day right of recission contract— I understand that I have made an agreement with Denvyrs Air Conditioning and Heating and waive my right to a 3 day recission. I have made the decision to use Denvyrs Air Conditioning and Heating to provide services in my home, and would like to proceed with the job as planned and stated on the reverse side of this contract. In the event that I do cancel this job, I am subject to a “restocking fee” and any deposits rendered for my job specified will be used to recover that “restocking fee.”
Repairs—I have read and hereby understand that any and all repairs completed by Denvyrs Air Conditioning and Heating do not represent the equipment reliability as a whole. Denvyrs Air Conditioning and Heating is only responsible for the repairs completed by Denvyrs Air Conditioning and Heating. All warranties on repairs do not automatically apply towards the entire system; in the event that additional repairs are needed after the completed repairs by Denvyrs Air Conditioning and Heating, Denvyrs Air Conditioning and Heating is not responsible for the additional repairs. Denvyrs Air Conditioning and Heating is solely responsible for their warranties provided on and in the contract specified on the reverse side of this invoice.
Heat Pump Replacement—I have read and hereby understand that Denvyrs Air Conditioning and Heating has educated and informed me of the new Heat Pump systems operating functionality, and I am aware that Heat Pump systems do not heat to the same temperatures that my natural gas system did. I fully understand that this system is all electric and runs through a defrost mode every 30 minutes, 60 minutes, and/ or 90 minutes depending on the geographical location and outdoor temperature factors. Denvyrs Air Conditioning and Heating has completely educated me on the new systems California is requiring us to install, and I am aware of the operational functions that this system comes with during its heating cycle. Denvyrs Air Conditioning and Heating can not, and will not, be financially responsible for storing any equipment removed from my property during a replacement installation, and will not be financially responsible for reinstalling such equipment in the event that this unit does not meet the standards of my previous natural gas heating system. I understand that the State Of California no longer offers Natural Gas units.
Installation— I have read and hereby understand that during equipment installations there may be certain issues that arise with drywall, plaster, electrical, roofing, and/ or plumbing when equipment is being replaced in my attic. Denvyrs Air Conditioning and Heating is not responsible for such drywall, plaster, electrical, roofing, and/ or plumbing repairs that may arise from the removal and replacement or installation or new equipment. I understand that if there is an issue that may arise, Denvyrs Air Conditioning and Heating will inform me of such issues and help me to better understand how to proceed with repairs.
Refusal Of Recommendations— I have read and hereby understand that Denvyrs Air Conditioning and Heating has recommended to me certain repairs that may not meet certain safety or code requirements, and I release liability of such issues from Denvyrs Air Conditioning and Heating. I understand that I am refusing to address any issues with mold, mildew, carbon monoxide, refrigerant EPA violations, asbestos, radon, fiberglass, indoor air quality concerns, roofing issues, plumbing issues, electrical concerns, efficiency requirements, airflow and air distribution recommendations, heat exchanger wear and tear, and any other repairs or concerns stated on or in the invoice on the reverse side. Denvyrs Air Conditioning and Heating has notified me of such repairs and I have chosen to decline the needed repairs at this time.
